Coast Southwest, Inc., a California corporation (“Coast Southwest,” “we,” “our,” or “us”) prioritizes protecting your privacy, including the information you share with us online and at our physical facilities. The following information serves as our privacy policy (“Privacy Policy”) and is intended to inform you of our policies for handling your personal information when you access our websites, utilize our goods or services, and apply for or maintain employment with us. 

Please read this Privacy Policy carefully with any other terms, including our Terms of Use, we may have provided you with when collecting your personal information or otherwise engaging with you. 

Personal information generally refers to information that directly identifies you or may be reasonably linked to your identity. For California residents, personal information has the meaning set forth in the California Consumer Privacy Act of 2018, as amended.

Coast Southwest does not sell your personal information to third parties. Additionally, Coast Southwest does not share your personal information with any third parties for the purposes of cross-context behavioral advertising or targeted advertising. We only collect and use personal information that you provide us with in accessing our websites, using our goods or services, and applying for or maintaining employment or a contractor relationship with us. Any potential uses of your personal information as outlined herein are for our limited internal use only, unless otherwise indicated.

When contacting us via our website, or otherwise accessing our website, we may collect your personal information to help us assess the functionality of our website, improve the quality of our online resources, or notify you about updates to our website. By accessing our website, providing us with your personal information, or using our goods and services, you agree to the terms of the Privacy Policy and Terms of Use. If we collect or use your information for other purposes than as outlined here, we will update the Privacy Policy to notify you of such changes. 

Our website, goods, services, and the like are intended for access and use by individuals over the age of 16 years old in the United States. All users must be over 16 years old. Please also see our Terms of Use. 

Collecting Personal Information 

The personal information we may collect is usually provided by you as a visitor on our website, potential customer, or existing customer. We only collect the information you provide to us or agree to allow us to collect. You may provide information to us through submission of a contact form, submission of a credit application, or other processes while accessing our website or purchasing our goods or services. This information may include your contact information, such as your name, company name, title at the company, phone number, and email address. When submitting a credit application to us, this information may also include your billing address, mailing address, bank references and their contact information, and trade references and their contact information. If you choose to decline to provide certain information that we request or require to obtain goods or services from us, please note that you may be prohibited from using our website or limited in taking advantage of any goods or services we may offer. 

We also may collect information provided by job applicants and employees, all of which such persons voluntarily provide us with. This personal information may include identifying information, such as your name, address, email, and driver license number; employment related information, such as your job history; device data as maintained on Company owned devices or networks; sensitive information, such as your social security number, passport number, and financial accounts; and your background information, such as race, gender ethnicity, and religion. While some of this information and more may be requested or required for employment, please note that some disclosures by you are optional, and you may decline to provide specific pieces of information, as applicable.  

When accessing our website, we may, automatically or upon request, store cookies on your device. Cookies are small text files placed on your device, and they help us enhance and improve website navigation and capabilities, track website usage, and analyze our general marketing efforts. You may adjust the cookies settings or implement other means to prevent us from storing cookies on your device. Some cookies may be stored on your device by our third-party website vendors, such as Google Analytics and Google Tag Manager, to help us understand how customers are using our website and how we can improve user experiences. We do not retain any personal information collected from you longer than necessary to achieve the purpose for which it was collected or as required by law, whichever is longer. 

Using Personal Information 

We may use your personal information for the following purposes: 

  1. Employment: We may use your personal information to assess employment opportunities and to verify eligibility for employment. If you are an existing employee, we may use your personal information to manage and assess human resources, to process payroll and benefits, and to coordinate with a benefits broker. We also use your personal information to properly maintain and update personnel records. 
  2. Operational: We may use your personal information to manage and track product sales and day to day operations, including but not limited to the transport of goods. 
  3. Technology: We may use your personal information to collect website user data; prepare website and user analytics; and improve internal technology, IT-related practices and procedures, and our website. 
  4. Marketing: We may use aggregated personal information from customers for operational and marketing management purposes. 

Securing Personal Information 

We have appropriate security measures in place in our information technology systems and at our physical facilities to protect against the loss, misuse, or alteration of your personal information. However, you acknowledge and agree that when supplying information online or using other technology systems, there is a risk of security breaches, maintenance issues, and other potential problems that may impact our ability to protect your information. Therefore, we cannot guarantee the security of your personal information online, and you assume such risks by supplying us with your personal information. 

California Consumer Privacy Act of 2018  

California residents have specific rights under the California Consumer Privacy Act of 2018, as amended (“CCPA”). This section of the Privacy Policy only applies to California residents. Any defined terms used below have the meaning provided in the CCPA, unless indicated otherwise. 

Under the CCPA, you have the following rights: 

  1. The right to know what personal information we collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom the business discloses personal information, and the specific pieces of personal information we collected you.
  2. The right to delete personal information we collected from you, subject to certain exceptions.
  3. The right to correct inaccurate personal information we maintain about you.
  4. We do not currently sell or share your personal information, but if we revise this Privacy Policy to begin doing so, you have the right to opt-out of the sale or sharing of your personal information by us.
  5. We do not use or disclose your sensitive personal information, however, if we revise this Privacy Policy to begin doing so, you may have the right to limit the use or disclosure of your sensitive personal information by us.
  6. The right not to receive discriminatory treatment by us for the exercise of these privacy rights, including an employee’s, applicant’s, or independent contractor’s right not to be retaliated against for the exercise of their CCPA rights.

To exercise your rights under the CCPA or to assist someone else in exercising their rights as their authorized agent, please contact us by calling 1-817-652-7400, or submitting a contact form with “CCPA Request” as the title. When you contact us with a CCPA request, we may request limited additional information from you to verify your request. 

As noted above, we do not sell or share your personal information or your sensitive personal information. We also do not sell or share the personal information of consumers under the age of 16 years old.

Internet or Other Electronic Network Activity Information Browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement This information is collected from employees when using the Company’s devices or network. 

If you accept cookies when accessing our website, we may store cookies on your device(s). 
We collect this information to manage, assess, and improve internal IT practices and procedures and our website. If you accept cookies, we may also collect this information to assess website usage, improve web performance, and assist marketing efforts.
Geolocation Data Data that is derived from a device and that is used or intended to be used to locate a consumer within a geographic areaThis information is only collected from employee truck drivers when operating Company owned vehicles. We collect this information for operational purposes, including but not limited to maintaining an electronic driver log process.

Other States’ Privacy Laws

Similar to the CCPA, the Utah Consumer Privacy Act (“UCPA”) provides Utah residents with specific rights concerning their personal data and sensitive data. The UCPA defines personal data as information that is linked or reasonably linkable to an identified individual or an identifiable individual, which is consistent with our general definition of personal information above, so the terms may be used interchangeably in this context. In the CCPA section above, we disclose to California residents which categories of personal data we collect; the purpose of collecting such data; and how someone may exercise their rights. Please refer to the CCPA section as the same disclosures and processes for exercising your rights are applicable to Utah residents.   

The UCPA defines sensitive data as (i) personal data revealing your racial or ethnic origin, religious beliefs, sexual orientation, citizenship or immigration status, or information regarding your medical history, health condition, or medical treatment or diagnosis; (ii) processing of genetic personal data or biometric data for the purpose of identifying a specific individual; or (iii) specific geolocation data.  As provided in the CCPA disclosures chart above, our collection of different categories of sensitive data is largely limited to individuals that the UCPA does not apply to, job applicants and employees. However, in the event we request sensitive data from you, please note that you have an opportunity to opt out of such collection of your sensitive data by contacting us at info@coastsouthwest.com.

To the extent that states which the Company operates in other than California, enact comprehensive privacy regulations similar to the CCPA and UCPA, we will update this Privacy Policy accordingly.
